This document contains the General Terms and Conditions of the purchase and sale agreement between "EM Studio Advertising and Creative" OOD, hereinafter referred to as Blagodae, on the one hand, and the person who agreed and accepted the General Terms and Conditions, hereinafter referred to as the "Client" for brevity ". By registering, requesting and purchasing from the electronic catalog, the "Client" unconditionally accepts Blagodae's "General Terms and Conditions", on the one hand, in connection with the application and purchase of the goods offered through https://blagodae.com/.


By using the Blagodae.com e-catalog, you are deemed to accept and agree to the "Terms and Conditions" described below, otherwise, please do not use this website!

GENERAL PROVISIONS

Definitions and Definitions

In the interpretation and application of these General Terms and Conditions, the following terms and expressions have the following meanings:

1."Website" ("website") is a designated place on the global Internet, accessible through its uniform address (URL), containing files, programs, text, sound, picture, image or other materials and resources. 
2. "EM Studio Advertising and Creative" Ltd is a commercial company with id. number 103943377, with address Varna, Trakata city, 11 "4-ta" street. 
3. "https://blagodae.com/" is an e-commerce website on the Internet for the sale of goods at a distance, which are delivered after the express request and consent of the Customer.
4. "Client" is an individual over the age of 18 or a legal entity that is registered under the Commercial Law and has agreed to these Terms and Conditions by registering and/or shopping at https://blagodae.com/.
5. "Customer Profile" is a separate part containing information about the Client and provided by him during registration. Access to the customer profile is achieved by entering a username and password. The customer profile enables the customer to view and edit the data entered by him and the entries made in the relevant forms, to have access to information about all his requests for the purchase of goods, to change his access password, etc. 
6. "Username" is a unique code of letters and/or numbers chosen by the Customer, by means of which it is individualized at https://blagodae.com/.
7. "Password" is a personal code of letters and/or numbers chosen by the Customer, which enables him to make valid requests for the purchase of goods and services.
8. "Manufacturer" is any natural or legal person who, by occupation, produces goods in a ready-to-use form or substantially changes or modifies products with a view to placing them on the market. 
9. "Package" are any devices and/or materials that contain and/or store various goods offered directly to the Customer.
10. "Sale price" is the final price for a unit of product or a certain amount of goods or for a service including VAT.
11. "E-reference" is a link indicated on a particular Internet page that allows automated forwarding to another Internet page. 
12. "IP Address" ("IP address") is a unique identification number associating the Customer's computer, Internet page or resource in a way that allows their location in the global Internet network.
13. "Commercial Messages" are advertising or other communications directly or indirectly representing the goods and services.
14. "Malicious actions" are actions or inactions that violate Internet ethics or cause harm to persons connected to the Internet or associated networks. 
15. "Web page" is an integral and distinct part of a website.

Subject
"EM Studio Advertising and Creative" Ltd. provides the Client with the opportunity to purchase the goods offered at https://blagodae.com/ after sending a request, registration and readiness to pay the relevant sales price, subject to consideration and strict compliance by the Client of these General Terms and Conditions, as well as the additional requirements for the specific goods.

Registration 
In order to obtain the right to make valid requests to purchase the goods offered at https://blagodae.com/, the Customer must have correctly completed the online electronic registration form. Registering at blagodae.com is free and optional, but entitles you to additional privileges and creates convenience when shopping.

When filling out the electronic registration form, the Customer is obliged to provide complete and correct data regarding his identity and other required data, ensuring that they are true, complete and accurate and, in the event of a change, will update them promptly (in the event that it does not concern single order). The customer can freely correct the information entered by him in the registration form. 

After agreeing to these General Terms and Conditions, the Customer may make valid requests to purchase goods through https://blagodae.com/ and shall be deemed bound by the terms of the General Terms and Conditions and undertake to comply with them.

Changes to the General Terms and Conditions
To the extent that the goods offered by Blagodae are diverse and constantly supplemented and modified with a view to their improvement and expansion of the product catalog, as well as in connection with legislative changes that reflect on the conditions for their offer, these General Terms and Conditions can be changed only and unilaterally by Blagodae . 
When making changes to the General Terms and Conditions, Blagodae undertakes to publish in a prominent place at https://blagodae.com/ a message about the text of the amendments or an electronic link to an Internet page where the amended General Terms and Conditions are available.

The changes in the General Terms and Conditions do not affect the relations between the Customer and Blagodae arising in connection with a request for the purchase of goods validly submitted before the notification.

Publishing information about the goods in https://blagodae.com/
Blagodae publishes at https://blagodae.com/ a description of the main characteristics and an image of each product, the sales price, including VAT, as well as a tariff for the value of postage or transport costs, not included in the price of the goods, related to their delivery , information on the methods of payment, delivery and deadline for delivery.

The order at https://blagodae.com/ goes through several stages:

PURCHASE REQUEST

To make your request to us, after you have already familiarized yourself with all the details and specifics about the product, you need to press the "Add to cart" button, which is located on the right, next to the "Quantity" field.

At any moment, you can check the current contents of the cart, see the prices of the products with VAT, find out the total value of the order, the amount for transport, compare the desired and requested quantity and update it - reduce, increase or opt out of a particular product by removing it from the cart by deleting it. All corrections to the products in the cart are made with the edit buttons.

IMPORTANT!

After the initial request has been made, you as our customer are entitled to an individual offer for large quantities. Only after all details have been clarified and written confirmation has been received from https://blagodae.com/ does the order move to the "Request Acceptance" stage.

ACCEPTANCE OF APPLICATION

The purchase request is accepted by the Blagodae.com team by sending a message to the e-mail specified by the Customer, which contains:

information about the main characteristics of the requested goods, its selling price, the value of postage or transport costs not included in the selling price and related to its delivery, the payment method chosen by the Customer, the specified invoice data and delivery address.

The request becomes effective between the parties after checking the availability of the goods requested for purchase and after confirming its validity at the e-mail address specified by the Customer.

FULFILLING AN ORDER

The purchase request is accepted by the Blagodae.com team by sending a message to the electronic mailbox for correspondence with the Customer, which contains: information about the main characteristics of the requested product, its selling price, the value of postage or transport costs not included in the selling price and related to its delivery, the payment method chosen by the Customer, the specified invoice data and delivery address. The request becomes effective between the parties after checking the availability of the goods requested for purchase and after confirming its validity at the e-mail address specified by the Customer.

Requests from the site are accepted 24 hours a day and are processed within the working day from 9.00 a.m. to 5.00 p.m. At each stage of processing such as confirmation of availability, time of production or import, delivery, etc. You will be notified in the system and/or by e-mail.

If we do not contact you by phone or email within 2 hours of placing an order, please contact us!

If an incomplete, incorrect or incorrect address and/or telephone number is provided when submitting the request, it is considered invalid and a representative of Blagodae will contact you for further clarification.

USE OF SUBCONTRACTORS

The Seller has the right to use subcontractors for the performance of the Services offered on the Site without the need to notify or obtain the Buyer's consent for this. The Seller will be responsible for the actions of these subcontractors as its own.

PRICES

All prices on hi-pos.com are in Bulgarian levs, including VAT. The indicated prices of individual goods are for a single quantity and do not include delivery costs. The amount owed by the Customer is a sum of the sales price at the time of submitting the purchase request, the delivery price and the cash on delivery fee compared to the Econt Express price tariff when this payment option is selected.

METHODS OF PAYMENT

Product prices and shipping costs can be paid as follows:

  • in advance by bank transfer;
  • upon receipt of the goods, by Postal Money Order

ATTENTION!!!

Blagodae.com has introduced a method of payment POSTAL MONEY TRANSFER / acc. concluded a contract with Econt Express OOD, for the performance of the service/

When paying cash on delivery is used Postal Money Order (PMO). The customer receives  document by Econt Express OOD as a licensed postal operator for postal money transfers within the meaning of the Postal Services Act. The customer keeps the document, which replaces a receipt as proof of payment!

Below we apply the normative grounds on which no receipt required when paying by postal money credit:

Art. 3. (1) Every person is obliged to register and account for the sales of goods or services carried out by him in or from a commercial establishment by issuing a fiscal receipt from FU or a receipt from IASUTD, except when payment is made by depositing money in balance on a payment account, credit transfer, direct debit or available money transfer made through a payment service provider within the meaning of the Payment Services and Payment Systems Act, or through a postal money transfer made through a licensed postal operator for making postal money transfers under the meaning of the Postal Services Act.

About: the amendments and additions to Ordinance No. H-18 of the Minister of Finance of 13.12.2006 on registration and reporting of sales in commercial establishments through fiscal devices, promulgated by SG No. 49/2010

 3.1. New types of payments, in which the obligation to issue a fiscal receipt is no longer required (Art. 3, para. 1 Art. 25 of the Ordinance).

According to the order existing until the amendment, the obligation to issue a fiscal receipt did not apply to cases where payment is made by bank transfer. Taking into account the modern development in the field of payment services, the cases for which it is not mandatory to issue a fiscal receipt include payments by available money order or by postal money order. It should be expressly noted that this exception applies to an available money transfer made through a company licensed to carry out available money transfer activities within the meaning of the Payment Services and Payment Systems Act or through a postal money order made through a licensed postal operator for making postal money transfers within the meaning of the Postal Services Act.

The Bulgarian National Bank (BNB) issues a license to operate as a payment institution for the operation of available money transfers within the meaning of the Law on Payment Services and Payment Systems (ZPUPS). The Bulgarian National Bank maintains a public register of payment institutions licensed by it. The register is available electronically and is regularly updated (Art. 17, Para. 3 of the Civil Code).

The Commission for the Regulation of Communications regulates the performance of postal services in accordance with the Postal Services Act (PSA) and issues, amends, supplements, suspends, terminates and revokes individual licenses for the performance of postal money transfers. The Commission for the Regulation of Communications enters the issued individual licenses in a special register, which is public (Article 50 of the ZPU)

Standard delivery times

The goods requested for purchase are delivered to the address specified by the Customer within the time limit:

For available goods:

up to 3-4 hours days after receiving the order for goods that are in stock and no stamp is required.
     

For goods that are offered with printing:

5-7 work days, for standard goods that include printing.
By agreement - for products according to the customer's order

For goods requiring importation:

Up to 14 days after order approval

For goods that are manufactured according to the customer's order or products that require import, a delivery time is agreed upon additionally.

The goods are delivered appropriately packed according to the type and transport for delivery.

DELIVERY OF THE GOODS

The goods are handed over to the Customer or to a third party who accepts and confirms receipt of the same on behalf of the Customer.

When handing over the goods, the Customer or the third party signs the accompanying documents. In the event that the Customer is not found within the delivery period at the address indicated by him or access and conditions for delivery of the goods are not provided within this period, Blagodae.com is released from its obligation to deliver the goods requested for purchase.

The customer can confirm his desire to receive the goods even after the expiry of the delivery period in which he was not found at the address, taking all the additional delivery costs. In this case, a new delivery period starts from the moment of confirmation according to the previous sentence.

Upon receipt of the shipment, check the contents of the package for a transport defect or inconsistencies of the sent goods with the submitted request! Mandatory before the courier!

Upon receipt of the shipment, you are required to check the products and if there is any discrepancy contact a Blagodae.com representative immediately. If this is not done, it is considered that the products are approved and meet the relevant requirements. If any defect is detected, we undertake to react within 24 hours of delivery, and you to store the products until the moment of their return in the form in which you received them.

ATTENTION!!! When paying in cash upon delivery, a courier of Econt Express OOD will issue you a document for the received payment, which serves as a receipt and is attached to the invoice issued by us.

Right of withdrawal

The customer has the right to refuse to receive the goods requested by him for purchase, when:

  • the delivered goods clearly do not correspond to the ones requested for purchase by the Customer and this can be established by a simple examination of them,
  • the product or its packaging was damaged during transportation,
  • the price to be paid by the Customer does not correspond to the price due.

A customer who is a consumer within the meaning of the Consumer Protection Act pursuant to Article 55 has the right, without owing compensation or a penalty and without stating a reason, to withdraw from the concluded contract for the purchase of goods through Blagodae.com by returning the goods within 14 working days from the date of receipt.

In the event that the Customer withdraws from the concluded contract within the period of the previous sentence, he should send a statement of withdrawal from the concluded contract to Blagodae.com and return the goods intact, unused and with tags left in place. Blagodae.com shall refund the Customer in full the sales price paid no later than 30 days from the date on which the Customer has exercised any of its right of withdrawal.

Attention!

Refusal of the request becomes obligatory in writing by e-mail. If the goods have already been sent by "EM Studio Advertising and Creative" OOD, you can refuse to accept them at the moment of receiving them from the courier, and the costs remain at the expense of "EM Studio Advertising and Creative" OOD. If you reject the goods after receiving them but within the fourteen day period stated above, you may return them at your own expense by courier or bring them on site to a Blagodae.com office

GOODS/SERVICES FOR WHICH THE CUSTOMER HAS NO RIGHT OF REFUSAL 

– for goods damaged and/or changed after the moment of their receipt;

– for the delivery of goods made according to the user's requirements or according to his individual order;

COMPLAINT

You can submit the complaint in writing by e-mail together with a photo of the damaged product as evidence. You must indicate the type and quantity of the product(s) subject to the complaint, your preferred way of satisfying the complaint, the amount claimed, the reasons for the complaint and a contact address.

In the event that your complaint is satisfied, the product(s) may be replaced with a new one/s within one month from the date of the complaint. If the replacement is not possible or does not take place within this period, you have the right to request a reduction in the price of the product(s) or to return it with a refund of the amount paid. As a customer, you cannot request that the product(s) be returned and the amount paid be refunded or the price reduced if you have received written confirmation that a replacement will be made within one month of the date of the complaint. You may not request the return of the product(s) and refund of the amount paid if the discrepancy is minor.

In the event that your claim is satisfied, "EM Studio Advertising and Creative" Ltd. issues a claim deed in two copies, one for both parties. According to the specifics of the claim, the transport costs are subject to additional negotiation between the parties.

In case of detected violations in the appearance of the packaging of the goods, contact the courier immediately, who is obliged to draw up a protocol for damage to the integrity of the shipment.

In the event of violations in the appearance of the goods, contact the courier immediately, who is obliged to draw up a report on damage to the goods.

Rights and Obligations of Blagodae.com
Blagodae undertakes:

  • to deliver within the agreed time the goods requested for purchase;
  • to accept goods returned by a consumer within the meaning of the Consumer Protection Act within the above-mentioned period of 14 working days.

Blagodae has the right to:

  • to place electronic links to other Internet pages and resources and advertising banners for the sale of goods and provision of services by third parties, including electronic links and advertising banners pointing to websites under the control of "eM Studio Advertising and Creative" OOD;
  • to send requested commercial messages to the Client in order to offer information and advertisements regarding its goods and/or services, as well as to make inquiries on a variety of issues, to conduct surveys and others;
  • to receive the announced price of the requested goods and the amounts due for their delivery.

Limitation of Liability
Blagodae takes care that the information in the Internet catalog is always kept true and up-to-date and guarantees its reliability.

Rights and obligations of the Client 
The customer undertakes:

  • to provide an accurate and valid telephone, delivery address and e-mail address for correspondence;
  • to pay the price of the goods requested by him;
  • to pay the shipping costs;
  • to receive the goods;
  • not to disclose your password and your answer to the secret question to third parties;
  • in view of the specifics of Internet protocols and security in the protection of password data, to terminate the session during which he entered his client profile by pressing the virtual "exit" button;
  • not to submit fictitious or invalid applications or other false information.

The customer is fully responsible for the protection of his password, as well as for all actions carried out by him or a third party by using it.

The customer has the right to:

  • online access to blagodae.com, subject to the conditions and access requirements set by Blagodae;
  • access and correction of your personal data online;
  • to receive the goods requested by him within the terms specified in the response to the request.

Personal data
Blagodae has the right to collect and use information about its Customers when they register. The information by which a Customer of the online catalog can be identified may include first name, last name, surname, address, telephone, e-mail address for correspondence and any other information that the Customer provides during registration and any other that the same enter or provide when requesting, receiving or using the services provided by Blagodae, participating in promotions, raffles and contests, completing survey cards, questionnaires, forms and others.

Processing of Customer Information 
In the registration form filled out by the Client upon registration, Blagodae indicates the mandatory or voluntary nature of providing the data and the consequences of refusing to provide them. By expressing agreement with these General Terms and Conditions, the Client agrees to have his/her information processed in the order provided for in them.

Purposes for which the information may be used 
Blagodae collects and uses the information for the purposes provided for in these General Terms and Conditions, as well as for offering new goods and/or services to the Client (free or paid), for offering goods and/or services offered by others, for promotions, for organizing raffles, inquiries, polls, to adapt the offered services to the preferences of portal members, for statistical and other purposes. 
By accepting these General Terms and Conditions, the Customer agrees to the processing of his personal data for direct marketing purposes. The customer has the right to object to the processing of his personal data for the purposes of direct marketing by sending a written message to Blagodae at the indicated address or e-mail for contacts.
By accepting these General Terms and Conditions, the Client is considered to have been notified within the meaning of Art. 34a, item 3 of the Personal Data Protection Act, that his personal data may be disclosed to third parties in compliance with the applicable legislation or used on their behalf for the purposes of direct marketing, and may at any time object to such disclosure or use by sending written notice to Blagodae at the address or e-mail address provided.
All the purposes described above for which the information may be used are not exhaustively listed and do not create obligations for Blagodae. Any other purposes for which the information is used will be in accordance with Bulgarian legislation, applicable international acts, Internet ethics, rules of morality and good manners.

Disclosure of information
Blagodae undertakes not to disclose any personal information about the Client and not to provide the collected information to third parties - government bodies, commercial companies, individuals and others, except in cases where:
a) has received the express consent of the Client upon registration or at a later time;
b) the information is requested by state bodies or officials who, according to the current legislation, are authorized to request and collect such information in compliance with the legally established procedures; 
c) in other cases specified by law.

Termination
Upon termination of the contract, Blagodae deactivates the customer profile and deletes the password for accessing the customer profile. 
The customer can at any time ask Blagodae to delete his customer profile. In this case, the deletion of the customer profile is carried out immediately after the fulfillment of all requests validly submitted by the Customer and corresponding payment by the Customer of the due sales price and delivery costs.
Apart from the cases provided for in these General Terms and Conditions, the contract between the parties is also terminated upon the occurrence of any of the following circumstances: 
1. suspension of Blagodae's activity; 
2. termination of maintenance of the online catalog or 
3. in other cases provided for by law.

Benefits 
The customer is obliged to indemnify Blagodae and all third parties for all damages suffered and lost profits, including any costs and attorneys' fees paid, incurred as a result of claims brought by and/or compensation paid to third parties in connection with non-fulfillment of its obligations under this contract, a violation of Bulgarian legislation, applicable foreign laws, these General Terms and Conditions, good manners or Internet ethics. 
The customer is also obliged to indemnify Blagodae for all damages caused by third parties to whom he has provided his password, when using the same. 
Blagodae is obliged to indemnify the Client for all damages caused by Blagodae intentionally or through gross negligence.

Dispute resolution
All disputes between the parties shall be resolved in a spirit of understanding and goodwill. In the event that no agreement is reached, all unresolved disputes arising out of or relating to the contract between the parties, including disputes arising out of or relating to its interpretation, invalidity, performance or termination, and disputes to fill gaps in the contract or its adaptation to new circumstances, will be resolved judicially by the competent court.

Written form
The written form is considered to be complied with by sending an e-mail, pressing an electronic button on a content page that is filled in by the Customer or marking a field (check box) on the Blagodae website, etc. similar, insofar as the statement is technically recorded in a way that makes it possible to reproduce it.

Intellectual property rights
Intellectual property rights on all elements and resources located on the hi-pos.com e-commerce website (including available databases) are subject to protection under the Copyright Act and related rights, belong to "eM Studio Advertising and Creative" Ltd. or to the correspondingly designated person who assigned the right to use blagodae.com and cannot be used in violation of current legislation. 
The Customer's right of access does not include the right to copy or reproduce information and to use objects of intellectual property, unless it concerns information of an insignificant volume intended for personal use, provided that the legitimate interests of the authors are not unreasonably damaged or other holders of intellectual property rights and in case the copying or reproduction is carried out for non-commercial purposes. Regardless of the above, the client has no right to remove the trademark signs and other intellectual property rights from his accessible resources, regardless of whether the holder of the relevant rights is "EM Studio Advertising and Creative" OOD or a third party. 
In the case of copying or reproduction of information outside of the permissible, according to the previous paragraph, as well as in case of any other violation of intellectual property rights on the resources of hi-pos.com, the Customer owes blagodae.com a penalty for each individual violation.

Applicable law 
The provisions of the current legislation of the Republic of Bulgaria shall apply to issues not settled by these General Terms and Conditions.
